Module Description: Enable learners to develop an enhanced understanding of debt restructuring and the range of approaches open to personal borrowers to manage debt. Appraise learners of current insolvency legislation and the potential impact it has on personal finance and debt restructuring. Equip learners with the necessary skills to be able identify a client’s debt restructuring needs whilst also understanding the client’s behaviour and the changes required to ensure that the client addresses both the financial and behavioural reasons for their current challenges
Learning Outcomes
On successful completion of this module the learner will be able to:
LO1 Comprehensively understand and assess the elements associated with personal debt restructuring
LO2 Evaluate the options available for ‘challenged’ borrowers (eg. Debt Restructuring vs Personal Insolvency vs Bankruptcy) as provided for in personal insolvency legislation
LO3 Identify when debt restructuring is the correct solution to personal financial problems and apply this knowledge through the use of case studies.
LO4 Construct realistic detailed personal debt restructuring plans.

Personal Insolvency Legislation (Personal Insolvency Bill 2012)
• 3 New Non-Judicial Debt resolution Processes: o Debt Relief Notices (DRN) o Debt Settlement Arrangements o Personal Insolvency Arrangements • Consider the legal’s, the practicalities and the reality of Personal Insolvency
Personal Insolvency Guidelines
• eg. household expenses, business expenses guidelines for debtors, etc (yet to be fully established) • MABS and their role
Assessment of Creditors & Credit Arrangements
• Review various credit arrangements • Understand different types of creditors • Recourse & non-recourse Loans • Valuing assets to borrowing and borrowing to assets
Secured versus Unsecured Debt
• Review difference between secured and unsecured debt • Assess the real value of security • Assess the impact of the covenants in loan agreements, particularly personal guarantees
