Learning Outcomes
On successful completion of this module the learner will be able to:

LO1 Explain the main requirements of unfair dismissal law
LO2 Conduct an investigation interview in line with best practice and following all legal requirements
LO3 Critically evaluate key legislation and cases in equality law and protected leaves.
LO4 Discuss contemporary issues in employment legislation including key cases and trends impacting employment contracts, agency workers and false self-employment and how that impacts employers.
LO5 Critically examine key areas of employment legislation including working time, health & safety (particularly bullying), data protection and payment of wages.
LO6 Identify the key legal elements for consideration around changing contracts in the workplace including TUPE and Redundancy.

Assessment Description:
Skills assessment covering the investigation of and handling of a disciplinary issue in the workplace, using a specific case scenario. Prepare for and conduct a live, simulated disciplinary meeting. Individual role play required where evidence of understanding of the purpose of the meeting, legislation, fair procedures and processes are demonstrated. Lecturers will play the role of the alleged accused and their manager, following the scenario outlined in the case.

In groups of 4 you will undergo an open-book, oral assessment. You are required to answer questions on key cases and legislation such as: DEC-E2001-016 Lisa Rodmell vs University of Dublin, Trinity College (Gender) DEC-E2017-086 Dave Barry vs Solas (Age) DEC – E2010-015 Long vsThe Hanly Group (Family Status) Determination No. DWT10163 A worker vs An Employer (working time and pay) Determination No. UD80/2014 MG vs EBS (AIB) (Contract of or for Services) ADJ-00029093 Walsh vs Econocom Digital Finance Ltd (Redundancy / TUPE case) Sweeney v The Board of Management of Ballinteer Community School [2011] IEHC 131 (Bullying case) (Please note you must have studied all cases and may be asked detailed questions on any case plus any piece of legislation. You will be called in to be examined in groups of 4, but each person is assessed individually. The time allowed per group of 4 is 1.5 hours) Both Tasks must be passed in order to successfully pass the module.
