LO1 |
Demonstrate a good knowledge and understanding of the Irish legal system and the sources of employment law. |
LO2 |
Demonstrate a good understanding of the difference between contacts of employment and contracts for services and the various terms expressed or implied therein. |
LO3 |
Identify and appreciate the relevant legislation and/or common law applicable to an employment issue and recognise the responsibilities, rights and duties which arise in the employer/employee relationship. |
LO4 |
Identify and appreciate the different mechanisms by which the employee can enforce their statutory and common law rights. |
LO5 |
Identify and apply the key provisions of relevant legislation and/or common law to situations where the employment relationship breaks down and apply principles of fairness. |

Sources of Law and Resolution of disputes
Sources of employment law. Distinction civil and criminal law in the context of employment disputes. Dispute resolution. Data protection obligations.

Types of Contracts
Contracts of service and contracts for service. Express and Implied Terms. Categories of workers and statutory protection - part-time workers, fixed term workers and agency workers.

Protective Legislation
Working Time - breaks, annual leave (including sickness implications), zero hour contract entitlements, working hours, prohibition on double employment. Wages - entitlements, deductions. Young Persons in Employment. Minimum Wage. Protected Disclosures - wrondoings, protections, disclosures. Aspects of health and safety - common law and statutory duty, penalisation. Protective Leave - Carers' leave, Parental leave - leave entitlements, request for changes, force majeure Leave. Maternity leave.

Equality Law.
Discriminatory grounds. Direct and indirect discrimination. Burden of proof. Harassment and adverse treatment. Redress.

Termination of relationship
Fair Procedures. Unfair Dismissals, Wrongful Dismissals, Injunctions. Notice. Transfers of Undertakings. Redundancy.

Assessment Description: Assessment will consist of a two hour examination where students will be offered a choice of at least four questions and required to answer at least three. Some questions will be in a ‘legal problem’ style format, where students must apply their knowledge and understanding of legal principles to a particular set of facts, situations or scenarios. Other questions may require students to examine and discuss a piece of relevant legislation, case or legal principle. |
